Motion hearing set for June 12 in dismissed NCUA board members’ lawsuit
The D.C. District Court set a June 12 motion hearing in the legal challenge from dismissed NCUA board members Todd Harper and Tanya Otsuka. The hearing will discuss both Harper and Otsuka’s motions for a permanent injunction and summary judgment, as well as the government’s cross-motion for summary judgment.
Harper and Otsuka, who were dismissed from the NCUA board April 16, are seeking reinstatement to the NCUA board and nullification of any action taken with Chairman Kyle Hauptman as the sole board member.
The Department of Justice, on behalf the NCUA, claims that the president can remove NCUA board members at will, while Harper and Otsuka claim their firings are in violation of federal statute.
