Oral arguments suspended in NCUA board members’ lawsuit

Oral arguments are suspended in the challenge by dismissed NCUA board members Todd Harper and Tanya Otsuka.  On Tuesday, the D.C. Circuit Court of Appeals ordered to hold the lawsuit pending the U.S. Supreme Court review of Trump v. Slaughter. The Slaughter case involves a Federal Trade Commission commissioner also dismissed by President Donald Trump and will address the question of whether a federal court may prevent a person’s removal from public office.

The U.S. Supreme Court plans to hear oral arguments in Slaughter during the December argument session, with a decision likely by June 2026.

Harper and Otsuka were dismissed in April, filing a lawsuit seeking reinstatement shortly after. The government filed its latest brief Sept. 12, with Harper and Otsuka’s reply due Oct. 3, and the government’s reply to them due Oct. 17.

America’s Credit Unions continues to firmly support an independent NCUA with a bipartisan, three-member Board as essential to the effective oversight of the credit union industry.
