Reinstatement of dismissed NCUA board members stayed by appeals court

A federal appeals court granted an immediate stay to the reinstatement of dismissed NCUA board members Todd Harper and Tanya Otsuka late Friday, pending the outcome of the appeal filed by the administration. A federal judge ruled Tuesday that President Donald Trump’s dismissal of Harper and Otsuka was unlawful and counter to Congressional intent. The administration filed its appeal later that evening.

Tuesday’s ruling reinstated Harper and Otsuka to the board immediately, and the two attended Thursday’s board meeting, but the stay now keeps them both off the board until the appeals process concludes.

Appellees must file a response to the emergency motion for stay pending appeal by August 4, and a reply is due August 11.
