Supreme Court review could address questions impacting NCUA lawsuit

The U.S. Supreme Court’s decision Monday to review the Federal Trade Commission’s (FTC) case Slaughter v. Trump will likely affect the pending lawsuit filed by ousted NCUA Board members Todd Harper and Tanya Otsuka. While the D.C. Court of Appeals plans to hear oral arguments in the NCUA lawsuit on Nov. 21, the Slaughter case will address the question of whether a federal court may prevent a person’s removal from public office.  

The Supreme Court also granted the Trump administration’s request for a stay to keep ousted commissioner Rebecca Slaughter off the FTC as the case moves through the court system. The Court will hear oral argument in the case during the December argument session.  That makes a decision likely by June 2026, which will provide Supreme Court guidance in the NCUA case.
