EO granting paid federal holidays will not affect Fed services, Reg. Z

The president issued an Executive Order (EO) designating Dec. 24 and Dec. 26 of this year as paid days off for employees of all executive departments and agencies of the federal government. The EO should not impact Federal Reserve Banks Services or timing for Regulation Z requirements.

Federal Reserve Bank Services are only closed on those federal holidays designated by statute under 5 USC 6103(a), which include:

  • Jan. 1 (New Year’s Day);
  • Third Monday in January (Martin Luther King, Jr. birthday);
  • Third Monday in February (Washington’s Birthday);
  • Final Monday of May (Memorial Day);
  • June 19 (Juneteenth);
  • July 4 (Independence Day);
  • First Monday in September (Labor Day);
  • Second Monday in October (Columbus Day);
  • Nov. 11 (Veterans Day);
  • Fourth Thursday in November (Thanksgiving); and
  • Dec. 25 (Christmas).

Regarding Regulation Z timing for purposes of recission, and the TILA-RESPA Integrated Disclosure (TRID) rule, the definition of “business day” means all calendar days except Sundays and the legal public holidays as stated in 5 USC 6103(a).

EO holidays are not statutory federal holidays under 5 USC 6103(a) so they do not change TRID or recission business-day calculations, and they do not close Fedwire, FedACH, or other Federal Reserve Services.
